A monthly draw, on the everycarpart.co.uk website, offered a prize of car valeting products to the retail value of £30.

Issue

The complainants, who received an e-mail informing them they had won the draw, objected that they had not received their prize.

EveryCarPart did not respond to the ASAs enquiries.

Assessment

Upheld

The ASA was concerned by EveryCarPart's lack of response and apparent disregard for the Code, which was a breach of CAP Code clause 2.6 (Non-response). We reminded them of their obligations under the Code and told them to respond promptly in future.

We were also concerned that EveryCarPart had not sent the advertised prize to the notified winners and had not confirmed when winners would receive their prize. We concluded that EveryCarPart were not justified in withholding the prizes and had caused unnecessary disappointment to those they had notified.

The ad breached CAP Code clauses 2.6 (Non-response), 27.4 (Sales promotion rules), 35.6 and 35.9 (Other rules for prize promotions).

Action

We told EveryCarPart not to run the prize draw in future unless they could guarantee that notified winners would receive their prize, and asked CAP to inform its media members of the problem with EveryCarPart.
