Issue
The complainant challenged the availability of Corsodyl Daily Gum and Tooth Paste in Boots stores.

Response
Boots said they were a stockist of the product and it had been available throughout 928 stores in the UK. They said that the ad stated the product would be available in "most stores" which made clear to readers that some stores were omitted from the promotion. They sent us figures that showed a significant number of units were available in stores in the area in which the complainant lived and could not understand why there had been difficulty in obtaining it.
Assessment
Not upheld
We noted Boots comments and were satisfied they had stocked the product in a wide range of stores throughout the promotion. Although we understood that the complainant had difficulty in sourcing the product, we considered that it was not indicative of a widespread problem with the availability of the promotional product and concluded the ad was unlikely to mislead.
We investigated the ad under CAP Code rules 27.4 (Sales promotions) 30.1 and 30.2 (Availability) but did not find it in breach.

No further action necessary.
