A listing for Abacus Travels on a price comparison website stated “£385 RT incl. taxes Phone only deal Birmingham (BHX) to Taipei (TPE) Depart between 16 Aug 10 - 30 Nov 10 Check return dates with partner … ”.
Issue
The complainant challenged whether the ad was misleading, because when he tried to purchase the flight at the advertised price he was told they had sold out and was offered a flight at a more expensive price.

Response
1Der Flights Ltd (1Der Flights) responded by telephone to say that although they had availability at the price stated in the ad, availability was limited and they had not sold any flights at that price.

Upheld
The ASA noted 1Der Flights' comments. Because they did not send evidence to show they had flights available at the price stated in the ad we concluded the ad was misleading.
The ad breached CAP Code (Edition 11) clauses 3.1 (Substantiation), 7.1 and 7.2 (Truthfulness) and 16.4 and 16.5 (Availability of products).
Action
The ad must not appear again in its current form.
