A leaflet, for a club night, included the text “TUESDAYS £1 PINT OF FOSTERS £1 SHOTS £2 JAGER BOMBS”.
Issue
The complainant, who attended the club night, challenged whether the ad was misleading, because drinks were sold at prices higher than those advertised.

The Bunker did not respond to the ASAs enquiries.

The ASA was concerned by The Bunkers lack of response and apparent disregard for the Code, which was a breach of CAP Code clause 2.6 (Non-response). We reminded them of their obligations under the Code and told them to respond promptly in the future.
We noted the ad stated "TUESDAYS £1 PINT OF FOSTERS £1 SHOTS £2 JAGER BOMBS". However, the complainant said the prices were double those advertised when he went to the club night. In the absence of substantiation for the price claims, we concluded that they were likely to mislead.
The ad breached CAP Code clauses 2.6 (Non-response), 3.1 (Substantiation), 7.1 (Truthfulness) and 15.1 (Prices).
Action
We reminded The Bunker to ensure they could demonstrate that prices were accurate in future promotions. We asked CAP to inform its members of the problem with The Bunker.
