A claim on an online auction website seen during November 2011, "3.42A for Assus X58L X80LE Z35H Laptop Battery Charger ... UK Stock ... Royal Mail First Class ... 1 Year Warranty".

Issue

1. The complainant challenged whether the claim "One year warranty" was misleading and could be substantiated.

2. The ASA challenged whether the advertiser had promptly refunded a consumer making a valid claim under an advertised money-back guarantee.

CSJ did not respond to the ASA's enquiries.  

Assessment

1.& 2. Upheld

The ASA was concerned by CSJ Ltd's lack of response and apparent disregard for the Code, which was a breach of CAP Code (Edition 12) rule 1.7 (Unreasonable delay). We reminded them of their responsibility to respond promptly to our enquiries and told them to do so in future.

We noted the complainant was unable to claim under the advertised warranty and also that CSJ had not sent evidence that other consumers had been refunded after making a valid claim. We therefore concluded that the ad was misleading.

The ad breached CAP Code (Edition 12) rules 1.7 (Unreasonable delay), (3.1 (misleading advertising), 3.7 (Substantiation), 3.53  and 3.55 (Guarantees and after-sales service).

Action

The ad must not appear again in its current form.
