The complainant objected that the e-mail breached the Code, because it did not provide a simple means of opting out of receiving e-mail marketing.

UK3.com Ltd t/a Registrars.co.uk (UK3) did not respond to our enquiries.

Assessment

Upheld

The ASA was concerned by UK3s lack of response and apparent disregard for the Code, which was a breach of CAP Code clause 2.6 (Non-response).  We reminded them of their obligations under the Code and told them to respond promptly in the future.

We noted UK3s e-mail did not provide a simple means of opting out of receiving e-mail marketing and that they did not respond to requests to suppress the complainant's details. We therefore concluded that the ad breached the Code.

The e-mail breached CAP Code clauses 2.6 (Non-response) and 43.4c (Database practice).

Action

The e-mail must not appear again in its current form.  We asked CAP to inform its members of the problem with UK3.
