Background Information
Misleading Advertising – Iron Easy t/a ironeasy.co.uk has breached the UK Advertising Standards Code for quoting prices exclusive of VAT.
The ASA published an adjudication against Iron Easy on 19 October 2011. The advertiser quoted prices for its ironing service exclusive of VAT. The ASA considered that, because it appeared the ad was targeted mainly at consumers, the prices should have been quoted inclusive of VAT. The adjudication stated that Iron Easy should ensure price statements in future ads included non-optional taxes, charges and fees.
Although the ASA has adjudicated against Iron Easy and has made several subsequent requests for an assurance of future compliance, Iron Easy continues to feature VAT-exclusive prices on its website. Because of Iron Easy’s continued non- compliance we took the decision to place their details on this section of the ASA website on 15 November 2011. These details shall remain in place until such time as Iron Easy has appropriately amended its website to ensure compliance with the ASA adjudication and the CAP Code.
Relevant Adjudication
The Iron Easy website, viewed on 26 April 2011, stated the price for the ironing service with a 24-hour turnaround as “£9.00 per kg”.
The complainant, who had used the ironing service and was charged an additional fee for VAT, challenged whether the ad was misleading, because the stated prices were exclusive of VAT.
Iron Easy did not respond to the ASA’s enquiries.
The ASA understood that the stated prices did not include VAT. Because it appeared the ad was targeted mainly at consumers and the prices were VAT-exclusive, the ASA concluded that it breached the Code.
