Background Information

Misleading Advertising – Systek Marketing Group is in breach of the UK Advertising Standards Code for making unproven claims about an email address list.

The ASA published an adjudication in relation to the website www.prospectemail.net on 11 July 2012.  The ASA investigated: whether Systek Marketing Group could substantiate claims made on the website www.prospectemail.net that one of the lists for sale was an opt-in only list of enthusiasts looking for horseracing opportunities; whether the list had been verified in the last 3 months, with those no longer interested in receiving emails relating to horseracing opportunities being removed; and whether Systek Marketing Group would guarantee to refund the purchase price if the buyer was not happy with the email list.

The ASA considered that Systek Marketing Group had not provided adequate evidence to substantiate the claims made on www.prospectemail.net and concluded that the ad was misleading. 

Systek Marketing Group has not made the necessary changes to the website www.prospectemail.net and has not responded to the CAP Compliance Team’s requests that it does so.

Because of Systek Marketing Group’s continued non compliance we took the decision to place its details on the ASA section of the website on 27 July 2012.  

These details shall remain in place until such time as Systek Marketing Group has removed or appropriately amended the claims on the website www.prospectemail.net to ensure compliance with the CAP Code.
