Background Information

Misleading Advertising: The ASA published an adjudication against Webhostuk Ltd trading as www.webhost.uk.net on 14 November 2012 (see below) after they failed to substantiate the claim “100% customer satisfaction”.

Despite repeated requests to remove the problem claim, Webhostuk Ltd trading as www.webhost.uk.net continues to feature it on its website www.webhost.uk.net. Because of Webhostuk Ltd trading as www.webhost.uk.net continued non-compliance we took the decision to place its details on this section of the ASA website.  These details shall remain in place until such time as Webhostuk Ltd trading as www.webhost.uk.net has removed or appropriately amended the claims on its website to ensure compliance with the CAP Code.

ASA Summary of Adjudication

A claim on a website for domain hosting services, www.webhost.uk.net, stated "Why choose us? 100% customer satisfaction". 

The complainant challenged whether the claim "100% customer satisfaction" was misleading and could be substantiated, because he had experienced a network failure lasting over 168 hours.

The ASA was concerned by WEBHOSTUK Ltd's lack of substantive response and apparent disregard for the Code, which was a breach of CAP Code rule 1.7 (Unreasonable delay). We reminded them of their responsibility to provide a substantive response to our enquiries and told them to do so in future.
Because WEBHOSTUK Ltd had not provided any evidence to substantiate the claim "100% customer satisfaction", the ASA concluded that the claim was misleading.
