Background Information

Misleading Advertising – is in breach of the UK Advertising Standards Code for making unsubstantiated claims for testing hormone imbalances.

The ASA investigated claims made on the website that saliva testing of hormones was able to identify hidden hormone imbalances. The ASA reviewed evidence provided by Alyssa Burns-Hill in relation to this claim but found the evidence did not substantiate the claims being made.  As a result, the ASA concluded that adequate substantiation in relation to saliva testing of hormones should be held before such claims were made on the website in future. 

In addition to this point of complaint, and while the ASA acknowledged that Alyssa Burns-Hill held a PhD and as such may use the title “Dr”, the ASA concluded that in the context of a website heavily concerned with health related matters, the use of the term “Dr” misleadingly implied that Alyssa Burns-Hill was a medically qualified doctor, when this was not the case.  The ASA concluded that the website should state that Dr Alyssa Burns-Hill PhD was not a medically qualified doctor in a clear and prominent position.

The CAP Compliance Team contacted Alyssa Burns-Hill about her website and considered that insufficient changes had been made to to make it compliant with the CAP Code.

Because the necessary changes have not been made, we took the decision to place details of the website on the ASA section of the website on 7 January 2013.

These details shall remain in place until such time as removes or appropriately amends the relevant claims to ensure compliance with the CAP Code.
