Misleading Advertising: Maisons du Monde breaks the UK advertising rules for making unsubstantiated claims about delivery shipping times on the website.

In 2017 the ASA investigated a webpage on for the “TERENCE Taupe-coloured cotton modular sofa bed left armrest” which stated “Ships within 5 weeks”.

The complainant, who did not receive their order within five weeks, challenged whether the claim "Ships within 5 weeks" was misleading. The ASA considered consumers would understand the claim “Ships within 5 weeks” to mean that the product would be released from the warehouse within five weeks from the date the product was ordered. In the absence of a response from Maisons du Monde, and thereby of any evidence that products were shipped within five weeks, the ASA concluded the claim had not been substantiated and was misleading. We note that the product page now states “Ships within 4 weeks” but consider this claim is also misleading in the absence of substantiation.

The CAP Compliance team contacted Maisons du Monde to seek compliance with the ruling but, in the absence of a response, took the decision on 6 December 2017 to place their company details on this section of the ASA website. These details shall remain in place until such time as Maisons du Monde has removed or appropriately amended the claims on to ensure compliance with the CAP Code.
