Misleading Advertising: MyCityDeal Ltd breaks UK Ad Rules by failing to include compulsory delivery charges in prices on groupon.co.uk

CAP Code Rule 3.20 states Marketing communications that state prices must also state applicable delivery, freight or postal charges or, if those cannot reasonably be calculated in advance, state that such charges are payable.

Several products in the Goods section of groupon.co.uk are subject to a flat delivery charge of £1.99. In 2017, as part of routine monitoring, the CAP Compliance Team contacted MyCityDeal to highlight that they were breaching the Code by failing to include compulsory delivery charges in prices quoted on their website.

As MyCityDeal did not propose a suitably timely resolution to address the issue we took the decision on 16 November 2017 to place them on this section of the ASA website. These details will remain in place until such a time as MyCityDeal has implemented a pricing approach which complies with the CAP Code.
