Misleading Advertising: Shaun Smith breaks the UK Ad rules by making misleading unsubstantiated potential earnings claims on 18kaweek.com.
The website 18kaweek.com currently makes the claims “$2,571 + A Day” and “Over $30,000 In 18 Days!” on a website which promotes an internet marketing earning scheme.
Section 3 of the CAP Code states that marketing must not mislead consumers. 3.7 outlines that marketers must hold substantiation for the objective claims which they make, whilst 3.11 explains that marketers must not mislead consumers by exaggerating the capability of performance of a product.
The ASA asked Shaun Smith to provide substantiation for the claims “$2,571 + A Day” and “Over $30,000 In 18 Days!” but no evidence was provided. Therefore, the ASA ruled that the ad was misleading.
The CAP Compliance team has instructed the advertiser on several occasions to amend their website to comply with the Code. However, 18kaweek.com continues to make the claims that were deemed misleading.
The CAP Compliance team has therefore taken the decision to place Shaun Smith on this section of the ASA website from 15 November 2018. This information will remain in place until such time as Shaun Smith amends its website 18kaweek.com to comply with the CAP Code.
