Background
Misleading Advertising: Action-Rehab breaks UK advertising rules for falsely implying that they were acting for purposes outside its business; and using the Care Quality Commission (CQC) trust mark to imply that they were authorised on the www.action-rehab.com website.
The ASA ruled that the claims were misleading because they implied that Action Rehab provided treatment directly at clinics that they owned or operated, rather than being a lead generator or referral company.
The ASA also ruled that by displaying the CQC logo on its website, Action Rehab implied that it was regulated by CQC, when this was not the case.
The CAP Compliance team contacted Action Rehab but, in the absence of an assurance to amend the website, took the decision on 20 December 2024 to place its company details on this section of the ASA website. These details shall remain in place until such time as Action Rehab has appropriately amended the claims on the www.action-rehab.com website to ensure compliance with the CAP Code.
