The rules in Section 3 (Misleading Advertising) of the CAP Code apply across all sectors and to all marketing communications covered by the CAP Code. Marketers are reminded that omitting material information which is likely to affect a consumer’s transactional decisions may be considered misleading by the ASA. See Misleading advertising.
The Renters’ Rights Act came into force on 1 May 2026. Further information is available in the Government’s Guide to the Renters’ Rights Act. The Act applies in England only; advertisers should note that different legislative requirements apply in other parts of the UK.
