CAP and BCAP have agreed to remove energy labelling rules from the Codes following a review and public consultation.

CAP Code rules 11.8 and 11.9, and BCAP Code rules 9.9 and 9.10, were introduced in 2011. They reflected the legal requirements in place at the time for including energy labelling and product fiche information in certain types of advertising.

In 2024, CAP and BCAP engaged in discussions with the Department for Energy Security and Net Zero, which oversees energy labelling and information policy and legislation, and statutory body the Office for Product Safety and Standards (OPSS).

The ASA has not received any complaints under these rules and the OPSS is already responsible for enforcing the relevant regulations. While many Code rules reflect requirements detailed in legislation, CAP and BCAP consider whether that's necessary on a case-by-case basis. In some cases, legislation is not reflected in the Codes when they are not considered the right way to enforce it.

CAP and BCAP consulted on removing the rules and associated advertising guidance between 3 February and 4 March 2025. No objections were received and CAP and BCAP decided to remove the rules and the associated advertising guidance.
